These General Terms and Conditions, hereinafter referred to as GTC, regulate the commercial relations between EVVO and the user who makes purchases through the website eu.evvohome.comowned by EVVO HOME EUROPE SLU, with Tax Identification Number B37556842 and registered office at Carretera de Madrid, 9, 37900, Santa Marta de Tormes, Salamanca, Spain.

The user declares to be eighteen years of age or older and the legal capacity to make a purchase and sale on the website eu.evvohome.com,

Users who make purchases on eu.evvohome.com, fully accept these GTC and are bound by them, as if they were written at the time of contracting/purchase.

It will be an essential requirement to read and accept the GTC, prior to the purchase of any product through eu.evvohome.com,

EVVO reserves the right to modify the GTC at any time and without prior notice.

The GTC shall always be accessible from the website, so that the user may consult them at any time.

EVVO reserves the right to refuse and/or suspend access to the services provided at eu.evvohome.com, for reasons of breach of contractual good faith, non-compliance with the applicable legislation, these GTC and/or cases of fraud detected by the company and/or any of its suppliers.

1.- PURCHASE PROCEDURE

The EVVO products offered in the store will be shown with their characteristics, price and photograph. The images of the products are indicative and not binding, may be subject to change for design reasons.

The purchase procedure is carried out by selecting the item you want. This will be added to your "shopping cart" whose icon will appear on the side.

The steps to follow will be found in the purchase process in advance and in a clear way.

2.- ORDER PLACEMENT AND CONFIRMATION

Once the order has been processed by the user, the online store registers it and sends an order confirmation email to the email address provided by the user.

This email will be considered Proof of Purchase, and the Customer must keep it for his file if necessary.

Spanish will be the language used to formalize the contract -changedby country .

The electronic document in which the contract is formalized will be filed and the user will have access to it in his client area.

3.- PRICES

The prices that appear in the web include taxes and may be modified and revised at any time if required.

5.- DELIVERY OF THE PRODUCTS

Appliances, accessories and spare parts will be delivered to the delivery address determined by the user.

The delivery time varies depending on the shipping method and destination. See shipping information.

Any damage to the product or its packaging must be reported to EVVO within 24 hours of receipt.

It will be the customer's responsibility to demand the complete packaging from the carrier, in case it was not delivered with the product.

6.- PRODUCT WARRANTY

In all products whose nature allows it, the warranty will be two years from the delivery of the same, unless another duration is indicated at the time of purchase, based on Directive (EU) 2019/771 of the European Parliament and the Council.

The warranty does not cover deficiencies caused by negligence, blows, improper use or manipulations, incorrect installation or repair not carried out by the authorized Technical Service when applicable or use of improper voltage.

If the product is defective, the seller will proceed, as appropriate, to the repair, replacement, price reduction or termination of the contract, all free of charge for the consumer.

The seller is liable for any lack of conformity within a period of two years from the time of delivery.

The consumer must inform the seller of such lack of conformity within two months of becoming aware of it.

The customer will always receive his invoice by e-mail within a maximum period of one week after making the purchase. The customer is responsible for keeping the invoice in good condition, whether in digital or physical format.

Under no circumstances can the product warranty be exercised if the corresponding invoice is not presented, whether in physical or digital format.

These conditions are valid only for domestic appliances, excluding the warranty in cases of commercial or industrial use.

7.- WITHDRAWAL, CANCELLATION AND RETURNS

The consumer (consumers or users are considered only natural or legal persons who acquire, use or enjoy the product as final recipients) shall be entitled under current legislation to withdraw from the contract within 14 calendar days from receipt of the goods, in accordance with the provisions of Directive (EU) 2019/2161 of the European Parliament and Council.

The right of withdrawal may be exercised through the Website by filling in the web form attached to the return request: See withdrawal form.

In the event that the User exercises his/her right to return or withdraw from the purchase, EVVO Home will refund the amount previously charged to the User, including delivery costs (with the exception of the additional costs resulting from the User's choice of a delivery method other than the least expensive ordinary delivery method), within a period not exceeding fourteen (14) calendar days from the date on which he/she was informed of the withdrawal decision.

The refund will be made by the same means of payment.

The User shall only be liable for any diminished value of the goods resulting from the handling of the goods other than what is necessary to establish their nature, characteristics or functioning.

All goods must be returned with their original packaging, original protections and in perfect condition.

Failure to comply with the above, EVVO reserves the right to refuse the return or to deduct from the amount to be returned the costs incurred for the adjustment of the goods necessary to re-establish their nature, characteristics or functioning.

The User will be the one to return the goods, assuming the costs of transport originated by the same, being free to choose the agency that best suits their needs.

Professionals: Those who, without being final recipients, acquire, store, use or consume goods or services for the purpose of integrating them into production, transformation, marketing, professional activity or provision to third parties, shall not be considered as consumers and users, and therefore do not benefit from the rights granted to consumers. EVVO shall not accept returns for withdrawal by companies.

- Cancellation of orders

If the User decides to cancel the order after completing the purchase, he/she may do so free of charge, provided that the order has not yet been shipped.

To make a cancellation you must contact Customer Service via email at info@evvohome.com. SIf the order has left EVVO's warehouse, the cancellation cannot be made.

To return the order, you will have to do it once you have received it and following the return conditions mentioned above.

In order to avoid any problems during the return of the product, it is vital that you make sure that the product is sent properly protected inside the original box with the original protections intended for this purpose (cork protections, cardboard protections, bubble wrap, etc.) and avoiding any kind of manipulation on it, since otherwise the product may suffer a depreciation.

The responsibility of being technically able to install or use the products, accessories or spare parts requested falls on the user.

The parties expressly agree that this contract shall be governed by and construed, in all its terms and conditions, in accordance with the European legislation in force.

The parties expressly submit, for any questions or differences that may arise due to the interpretation, fulfillment and execution of this contract, to the jurisdiction and competence of the Courts and Tribunals corresponding to the domicile of the buyer or to those of the place of fulfillment of the contractual obligation.
